Eligible employees are able to take up to 26 workweeks of leave in a 12-month period, inclusive of FMLA leave taken for other qualifying reasons. This 12-month period is specifically defined as starting from the first day leave is taken to care for a covered service member, so an employer may have to run two FMLA “clocks” for one employee: the 12-month period it has chosen for other types of FMLA leave (fiscal, calendar, backward-rolling) and this 12-month period.
Leave for Qualifying Exigencies for Families of Military Members. Eligible employees may also take FMLA leave to address certain qualifying exigencies for the employee’s spouse, son, daughter, or parent who is a military member on covered active duty. The definition of covered military members includes those serving in the Regular Armed Forces on covered active duty, as well as the National Guard and Reserves. This also includes a foreign country deployment requirement. Qualifying exigencies are defined as:
Short-notice deployment.
Military events and related activities.
Child care and school activities.
Financial and legal arrangements.
Counseling.
Rest and recuperation.
Post-deployment activities.
Additional activities where the employer and employee agree to the leave.
